1 Basis of Contract
The submission of your booking form constitutes an offer to rent the Property from Keith Graham, Bristowe Hill Estates Ltd, in accordance with these Terms and Conditions, as well as the House Terms and Conditions. Your booking is considered accepted only upon receipt of the deposit and the subsequent email confirmation from us, at which point a binding contract (the “Contract”) will come into effect. The Contract, along with any referenced documents, forms the entire agreement between us. This Contract is governed by and construed in accordance with English law, with exclusive jurisdiction granted to the English Courts. This Contract is intended solely for holiday purposes and does not establish a landlord-tenant relationship.
Deposits:
A deposit is required for bookings made more than 90 days before the commencement date. For bookings made 90 days or fewer before the commencement date, full payment of the rental fee, along with any cautionary deposit, is required. A £1,000 deposit is necessary to secure your booking. If Bristowe Hill does not receive this deposit within 5 days of the provisional booking, we reserve the right to cancel your booking and re-advertise the property. The remaining balance is due 90 days before your arrival. Your booking is not complete until you receive a confirmation email.
2 Payment
A booking deposit of £1000 is payable if the booking is made more than 90 days prior to the commencement of the holiday period (“Commencement Date”). The balance of the booking price, along with a Cautionary Deposit (see Section 3 below), is due 90 days before the Commencement Date. Non-payment of the balance by the due date will be considered a cancellation of the Contract by you. For bookings made less than 90 days before the Commencement Date, the full Booking Price and Cautionary Deposit are payable upon submission of the booking. Payment details are provided in the email statement under “Payment Information”.
3 Cautionary Deposit
The Cautionary Deposit of £500 is payable to Bristowe Hill by BACS 14 days prior to the commencement date. You are required to adhere to the obligations outlined in Sections 10 and 11 during your stay. Any costs incurred to remedy breaches of these obligations, as well as costs for any additional services or goods provided, will be deducted from the Cautionary Deposit. The remaining balance will be refunded promptly after the end of the holiday period.
4 Cancellation
Cancellation Policy:
All cancellations must be submitted in writing and addressed to Lucie Graham at 10 Penrith Road, Keswick, CA12 4HF, or via email at stay@bristowehill.co.uk. We will make every effort to re-let the property.
Cancellations More Than Three Months Prior to Rental Date:
- If the property is not re-let: No refund of any monies paid will be issued.
- If the property is re-let at the same rate: Your deposit will be refunded, less a 10% administration fee.
Cancellations Less Than Three Months Prior to Rental Date:
- If the property is not re-let: No refund will be issued, and any outstanding balance will be invoiced if not yet paid.
- If the property is re-let at the same rate: You will be refunded the full amount paid, less a 10% administration fee.
- If the property is re-let at a reduced rate: You will be refunded the amount of the replacement booking, less a 10% administration fee.
Breach of Contract:
In the event of a breach of these conditions or the Contract, no refund will be issued, and any outstanding balance will be invoiced.
Recommendation for Cancellation Insurance:
We strongly recommend obtaining cancellation insurance to protect against unforeseen circumstances.
5 Changes of Date
We may, at our discretion, agree to change the dates of your holiday upon receiving a written request. If the dates are not changed, the booking will remain as is, with all monies due as per the original agreement.
6 Period of Hire
Check-in is at 5:00 PM and check-out is at 10:00 AM unless prior arrangements have been made with Bristowe Hill.
7 Noise Policy
The noise policy, as detailed in the House Terms and Conditions, must be adhered to throughout the holiday period.
8 Use of Property
The number of occupants must not exceed the maximum stipulated in the House Terms and Conditions. The property is for personal and domestic use only and shall not be used for commercial purposes without our written consent. We reserve the right to refuse entry to the entire party if these conditions are not observed.
9 Complaints
Any complaints during your stay must be promptly reported to us. In the case of serious issues, complaints should be confirmed in writing.
10 Breakages or Damage
You are responsible for any breakages, damages, or additional cleaning required. Costs will be deducted from your Cautionary Deposit, and you may be invoiced for any amounts exceeding the deposit.
11 Care of the Property
You are expected to take good care of the property, including its grounds and furnishings. You will be responsible for the repair of any damages.
12 Pets
Guests must adhere to the pet policy as outlined in the House Terms and Conditions.
13 No Smoking Policy
All properties are strictly non-smoking.
14 Liability
We, our employees, and agents, shall not be liable for any accident, damage, loss, injury, expense, or inconvenience arising from the letting. No term of the Contract is enforceable under the Contracts (Rights of Third Parties) Act 1999 by a person who is not a party to the Contract. If the property becomes unavailable before the booking date, our obligation is to (1) use our best efforts to find a suitable alternative, or (2) reimburse you for any payments made.
15 Warranties
We do not warrant or take responsibility for the accuracy of any verbal information or statements made by our staff.
16 Website and Advertisements
We strive to ensure that the information and descriptions provided on our official website and authorised third-party platforms are accurate. However, there may be minor differences as we continually seek to improve our services. We cannot accept responsibility for any changes or closures to local amenities or attractions mentioned on the website or elsewhere.
17 Right of Entry
We reserve the right to enter the property at reasonable times for inspection, repairs, or maintenance.
18 Children
You are responsible for the safety of your children.
19 Cancellation Insurance
We strongly recommend obtaining cancellation insurance.
20 Pricing
We reserve the right to change the advertised prices of our properties at any time without prior notice. The price confirmed at the time of booking, excluding any extras, is fixed and will not change. Prices include VAT where applicable.
